This Carrier Agreement applies to every person or business that posts a trip on Backload Live ("you", "carrier", "operator"). It is in addition to our Terms & Conditions and Privacy Policy. By posting a trip you confirm you have read, understood, and agree to be bound by this Agreement.
1. Independent contractor — no agency
You operate as an independent business. Nothing in this Agreement creates a partnership, joint venture, employment, agency, or franchise relationship between you and Backload Live. You are not our employee, agent, or subcontractor. You set your own rates, accept or decline jobs at your discretion, and use your own vehicle, tools, and labour.
2. Marketplace role
Backload Live is a connection platform only. We do not arrange, schedule, dispatch, accept, broker, or guarantee any transport job. We do not contract with customers for the carriage of goods. Every transport contract is formed directly between you and the customer.
3. Licensing, registration & insurance (mandatory)
You must hold and maintain at all times, at your own cost:
- A current and valid driver's licence appropriate for the vehicle.
- Current vehicle registration and roadworthy compliance.
- Compulsory third-party (CTP) insurance.
- Public liability insurance with a reasonable level of cover for your operation.
- Goods-in-transit (carrier's) insurance covering the goods you carry, or a written carrier's liability limit clearly disclosed to your customer before pickup.
- An ABN, and GST registration if your turnover requires it.
4. Heavy Vehicle National Law & Chain of Responsibility
You are solely responsible for compliance with the Heavy Vehicle National Law (HVNL) and any state-based road transport laws, including (without limitation): mass, dimension and loading limits; load restraint; speed; fatigue management; maintenance; and dangerous goods rules. Backload Live does notset schedules, demand delivery times, dispatch loads, allocate work, control how you drive, or instruct you on routes. You confirm that nothing on the platform (including departure-time fields, route listings, or messages from customers) will be treated by you as a direction that compromises your HVNL compliance. You must refuse any job that would require a breach of the HVNL.
5. Customer-facing conduct
You must:
- Provide accurate trip, vehicle, capacity, rate, and departure information.
- Honour quotes and agreed pricing once accepted by a customer.
- Communicate professionally and promptly.
- Disclose your insurance position and any liability cap to the customer in writing before pickup if asked.
- Not collect personal information from customers for any purpose other than the job arranged.
6. Identity verification
To protect customers, you must complete identity verification through our third-party provider (Stripe Identity) before customers can message you. Verification confirms identity only — it is not an endorsement by Backload Live of your competence, vehicle, insurance, or business practices. 6b. Business (ABN) verification
You may optionally verify your business by submitting your ABN and registered business name. We check this against the public Australian Business Register (ABR) via the ABR Web Services lookup. If your ABN is active and your submitted business name matches the ABR record, an "ABN verified" badge will appear on your Discovery profile. By submitting your ABN you confirm you are authorised to operate under that ABN and that the business name you submit matches the entity registered with the ABR. ABN verification is not an endorsement by Backload Live, and may be revoked if your ABN becomes cancelled or if you submit misleading information.
6a. Estimates & quotes — how the math works
The price estimates shown to customers anywhere on Backload Live are generated from your own published rates (standard rate, backload rate, and minimum charge) and real road distances returned by our mapping provider (Mapbox). Backload Live does not set, mark up, or take a cut of any quote. Two estimate types are calculated:
- Backload estimate (on your live trip pages): the customer's pickup-to-dropoff leg is split into two parts — the portion that overlaps your existing route is billed at your backload rate, and any extra distance you must drive to collect or deliver (deviation) is billed at your standard rate. The minimum charge is applied if the total falls below it.total = max(minimumCharge, (overlap km × backload rate) + (extra km × standard rate))
- Dedicated job estimate (on your public profile): the pickup-to-dropoff distance is billed at your standard rate, plus a depot deadhead (depot → pickup and dropoff → depot at your standard rate) so the truck can leave from and return to its base.total = max(minimumCharge, (leg km + depot round-trip km) × standard rate)
All estimates are non-binding. You confirm or counter the final price when you accept the job. If your published rates are wrong, customer estimates will be wrong — review them in your profile at any time.
7. Payments
Customers pay you directly. Backload Live does not handle, hold, process, or remit transport-job funds. You are responsible for issuing tax invoices, collecting and remitting GST (if registered), and reporting income to the ATO. Backload Live is not a withholding agent, paying agent, or principal in any transport transaction.
8. Indemnity
To the maximum extent permitted by law, you indemnify and hold harmless Backload Live, its directors, employees and contractors from and against any and all claims, demands, losses, damage, fines, penalties, legal costs and liabilities arising directly or indirectly from:
- Loss of, damage to, or delay of any goods you carry.
- Personal injury, death, or property damage caused by you, your vehicle, or your sub-contractors.
- Your breach of any law, regulation, or this Agreement.
- Any dispute between you and a customer.
- Any false, misleading, or unlawful content you post on the platform.
9. Limitation of Backload Live's liability
To the maximum extent permitted by law, Backload Live's total aggregate liability to you under or in connection with this Agreement and your use of the platform is limited to the lesser of (a) AUD $100, or (b) the platform fees you paid us in the 12 months immediately before the claim arose. We exclude all liability for indirect, consequential, special, or punitive loss, lost profits, lost revenue, lost goodwill, or business interruption. Nothing in this Agreement excludes rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.
10. Suspension & termination
We may suspend, restrict, or terminate your account at any time, with or without notice, if we reasonably suspect you have breached this Agreement, the law, or our community safety standards, or if a customer reports serious misconduct. No refund of any subscription fee is payable on termination for breach.
11. Reporting & safety
You must promptly notify us of any serious incident, accident, theft, fraud, or customer dispute that involves the platform. We may share information with law enforcement where required.
12. Changes to this Agreement
We may update this Agreement from time to time. Material changes will require you to re-accept this Agreement before posting your next trip. The "Last updated" date above reflects the most recent revision.
13. Governing law
This Agreement is governed by the laws of the State of Queensland, Australia. You submit to the exclusive jurisdiction of the courts of Queensland.
14. Acceptance
By ticking the acceptance box on the platform and posting a trip, you confirm you have read, understood, and agree to this Carrier Agreement, our Terms & Conditions and our Privacy Policy.
