Terms & Conditions

1. Platform role

Backload Live is a connection platform only. We are not a transport provider, freight forwarder, broker, agent, or carrier. We provide a marketplace where independent carriers list available capacity and customers contact them directly. We do not arrange, schedule, dispatch, accept, or guarantee any transport job, and we are not a party to any transport contract formed between a customer and a carrier. Carrier obligations are set out in our Carrier Agreement.

2. Liability & limitation

Backload Live is not responsible for loss, damage, theft, delay, injury, fraud, non-performance, or disputes between users. All transport arrangements are entered into directly between the customer and the carrier at their own risk. To the maximum extent permitted by law, our total aggregate liability to you arising out of or in connection with the platform is limited to the lesser of (a) AUD $100, or (b) the fees you paid us in the 12 months immediately before the claim arose. We exclude all liability for indirect, consequential, special, or punitive loss, lost profits, lost goodwill, or business interruption. Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

3. Carrier responsibility

Carriers are responsible for holding and maintaining all required licensing, insurance, vehicle compliance, and legal obligations applicable to the transport services they offer. By creating a listing, carriers also agree that their contact details (including phone number) may be shared with customers to enable direct communication.

3a. Carrier identity verification

To protect customers from fraud and freight theft, all carriers must complete identity verification before they can receive messages from customers. Verification is performed by our third-party identity provider (Stripe Identity) and includes a government-issued photo ID check and a live selfie/liveness check to confirm the person posting trips is who they claim to be. Carriers who have not completed verification will have messaging disabled on their listings, and customers will see a clear safety warning instead of a contact form. Verified carriers display a green "Verified" badge on their trips. Verification status may be revoked at any time if a carrier is reported, found to have provided false information, or otherwise breaches these Terms. Existing carriers active on the platform prior to the rollout of identity verification have been grandfathered in; we may require them to

3b. Business (ABN) verification

Carriers may also verify their business by submitting their Australian Business Number (ABN) and registered business name. We check this against the public Australian Business Register (ABR) via the ABR Web Services lookup operated by the Australian Government. If the ABN is active and the business name matches the ABR record, an "ABN verified" badge is displayed on the carrier's Discovery profile. ABN verification is optional, complementary to identity verification, and is not an endorsement of the carrier's competence, insurance, or vehicle. Verification status may be revoked if the ABN becomes cancelled or the carrier is found to have submitted misleading details.

4. Customer responsibility & insurance verification

Customers must independently verify the carrier's licence, registration, insurance (including public liability and goods-in-transit cover), and suitability before engaging them. Backload Live does not vet, endorse, hold copies of, or guarantee any carrier's insurance, vehicle, conduct, or the safety or completion of any job. Identity verification confirms identity only — it is not an endorsement.

4a. Chain of Responsibility (HVNL)

Backload Live does not schedule loads, set delivery times, dispatch drivers, allocate work, or instruct carriers on routes, speed, or fatigue management. Departure-time fields, route listings, and customer messages are informational only and must never be treated by a carrier as a direction that compromises compliance with the Heavy Vehicle National Law. Each carrier is solely responsible for HVNL compliance.

4b. Disputes between users

Any dispute about a transport job — including damage, loss, late delivery, payment, or conduct — must be resolved directly between the customer and the carrier. Backload Live is not obliged to mediate, investigate, or compensate any party in any such dispute and is not a party to the transport contract.

5. Operator subscriptions

Posting trips on Backload Live requires an active operator subscription. Plans are billed in Australian dollars (AUD) and include:
  • Operator Base — $39/month or $397.80/year (15% off annual).
  • Operator Pro — $44.50/month or $453.90/year (15% off annual). Includes priority placement, the verified-users-only listing toggle, and a Featured badge.

6. Free trial & auto-renewal

New operator accounts receive a 60-day free trial on their first subscription. Payment details are collected at signup but no charge is made until the trial ends. At the end of the trial, your plan automatically converts to the paid plan you selected and your card is charged for the first billing period. All subscriptions auto-renew at the end of each billing period (monthly or annual) using the payment method on file, until cancelled.

7. Verified Consumer subscription

Customers who subscribe to Verified Consumer ($9/month AUD) receive access to verified-only listings. This subscription requires a Backload Live account and does not include a free trial. It auto-renews monthly until cancelled.

8. Cancellation, refunds & failed payments

You may cancel any subscription at any time from the billing portal in your profile. Cancellation takes effect at the end of your current billing period — you keep access until then. All subscription fees are non-refundable. We do not offer refunds or pro-rated credits for unused time, partial billing periods, downgrades, forgotten cancellations, or periods where you did not actively use the platform, except where a refund is required by Australian Consumer Law. If a payment fails, your listings will be hidden and you will be unable to post new trips until the payment is resolved.

9. Promotional codes & complimentary access

From time to time we may issue access codes that grant a limited period of free platform access (for example, promotional or staff codes). Access granted via a code is non-transferable, has no cash value, is not refundable or exchangeable, and may be revoked at any time if the code is misused. When complimentary access expires, a paid subscription is required to continue posting trips.

10. Pricing transparency & changes

All prices listed are in AUD and shown inclusive of any applicable taxes unless stated otherwise. We may change subscription pricing with at least 30 days' notice via email or in-app notice. New prices apply at your next renewal — you may cancel before the renewal if you do not accept the new price.

10a. Estimates & quotes — how the math works

Prices shown anywhere on Backload Live are estimates only, generated from the operator's own published rates and real road distances returned by our mapping provider (Mapbox). They are not a binding quote from Backload Live or the operator. The final price is set by the operator when they accept the job.

There are two estimate types you may see:

  • Backload estimate (shown on a live trip page): you are asking to share a truck that is already heading your way. The price is the backload rate × the shared (overlap) distance, plus the standard rate × any extra distance (deviation) the operator must drive to collect or deliver your goods, with the operator's minimum charge applied if the total is lower.
  • Dedicated job estimate (shown on an operator's profile): you are asking the operator to do a one-off trip just for you. The price is the standard rate × pickup-to-dropoff distance, plus a depot deadhead (depot → pickup and dropoff → depot at the standard rate) so the truck can leave from and return to its base, with the minimum charge applied if the total is lower.

The "Dedicated truck price" shown next to a backload estimate is a comparison only — it represents what the same job would cost as a dedicated trip from the operator's depot, including the deadhead in both directions. The savings figure shown is the difference between the two.

11. Payments between users

Transport-job payments occur directly between customers and carriers. Backload Live does not handle, process, or hold funds for any transport job arranged through the platform. Subscription payments are processed by our payment provider (Stripe).

12. Account deletion

You may delete your account at any time from your profile. Deleting your account permanently removes your profile, deactivates your trip listings, and cancels any active subscription effective immediately. No refund is issued for the remaining portion of your billing period. Deletion is permanent and cannot be reversed. Conversation history with customers may be retained in anonymised form where required for legal, fraud-prevention, or dispute-resolution purposes.

13. Acceptable use

You agree not to: post false, misleading, or duplicate listings; impersonate another business; harvest contact details for marketing or spam; attempt to bypass subscription requirements; or use the platform for any unlawful purpose. We may suspend or terminate accounts that breach these rules without refund.

14. Changes to the platform & these terms

We may add, change, or remove features, listings, pages, or functionality at any time to improve the platform or comply with legal requirements. We may also update these Terms from time to time; the "Last updated" date above reflects the most recent revision. Continued use of Backload Live after changes are posted constitutes acceptance of the updated Terms.

15. Acceptance

By creating an account, starting a subscription, redeeming an access code, or contacting a carrier through Backload Live, you confirm that you have read, understood, and agree to these Terms & Conditions and our Privacy Policy.
